End-User License Agreement (EULA) for Racr

Effective Date: 01/01/2024

1. Acceptance of Terms:

By downloading, installing, or using the Racr mobile application ("App") provided by Syvertson Technologies LLC ("Company," "we," "us," or "our"), you agree to be bound by the terms of this End-User License Agreement ("EULA"). If you do not agree to these terms, please refrain from using the App.

2. License Grant:

a. The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

b. This license is granted solely for your use of the App in accordance with these terms.

3. Restrictions:

a. You may not, under any circumstances:

• Modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.

• Use the App for any purpose that is illegal or prohibited by applicable laws.

• Distribute, sublicense, lease, rent, or otherwise transfer rights to the App.

4. User Accounts:

a. To access certain features of the App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials.

b. You agree to provide accurate, current, and complete information during the account registration process.

5. Privacy Policy:

a. Your use of the App is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and disclose your personal information.

6. Termination:

a. The Company reserves the right to terminate your license to use the App at any time, for any reason, without notice.

b. Upon termination, you must cease all use of the App and delete it from your device.

7. Updates and Changes:

a. The Company may release updates or changes to the App, which may include bug fixes, improvements, or new features. Your continued use of the App constitutes acceptance of such updates.

8. Intellectual Property:

a. All intellectual property rights in the App are owned by the Company and are protected by copyright, trademark, and other laws.

b. You acknowledge that the App is licensed, not sold, to you.

9. Disclaimer of Warranty:

a. The App is provided "as is" and "as available" without any warranties, either expressed or implied. We do not guarantee the accuracy, reliability, or performance of the App.

10. Limitation of Liability:

a. To the extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of the App.

11. Governing Law:

a. This EULA shall be governed by and construed in accordance with the laws of the United States of America.
